TERRY WAHLS, LLC — LIVE EVENT RELEASE
In connection with, and as a condition of, the undersigned’s attendance at events conducted by Dr. Terry Wahls, LLC and their affiliates (“WAHLS”). I confirm, acknowledge and agree as follows:
- Content
The Event is purely an educational Event put on by WAHLS and is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual.
All materials, procedures, policies, and standards, all teaching manuals, all teaching aids, and the like that have been or will be made available to me or any other participant in this program, from WAHLS, oral or written, are for my personal use in or in conjunction with this program only.
I understand and agree that the information from this Event is for my personal use only, and may not be sold, tape recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of WAHLS or its designated agent. I also understand that I, while free to share my experiences and my personal results of this training, will keep the experiences and statements, oral or written, of all other participants in this training in the strictest of confidence.
- Right to Use Name & Likeness
I hereby authorize and grant to WAHLS and its agents and assigns, an irrevocable license and permission to use my name, photograph, likeness, voice, testimonial and biographical material, in whole or in part, for publication or reproduction in any medium, including but not limited to television, radio, print media and the Internet, among others, for any purpose, including but not limited to public relations, education, advertising, marketing, training and research. My consent extends to such use without restriction or limitation as to time or geographic boundary.
I hereby waive all rights I may have to any claims or demands for payment or royalties in connection with the use of any of such materials, regardless of the purpose of such use or publication, and regardless of whether a fee is charged or collected by WAHLS for any product and/or service in connection with such use and publication. I also waive any right to inspect, review or approve any photograph, recording, or other written material at any time, and waive the right to approve the use and medium of publication determined by WAHLS.
- Release & Liability Waiver
In consideration of and as part of my payment for the right to participate in WAHLS’s Event, the undersigned, my heirs, executors, administrators, successors and assigns do hereby RELEASE, WAIVE, ACQUIT, DISCHARGE, INDEMNIFY, DEFEND, HOLD HARMLESS AND FOREVER DISCHARGE WAHLS, and its owners, subsidiaries, principals, directors, employees, agents, heirs, executors, administrators, successors, and assigns and any of the training instructors, guides, staff or students taking part in the training in any way as well as the venue where the Events are being held and any of its owners, executives, agents, or staff OF AND FROM ALL ACTIONS, CAUSES OF ACTION, CONTRACTS, CLAIMS, SUITS, COSTS, DEMANDS AND DAMAGES OF WHATEVER NATURE OR KIND IN LAW OR IN EQUITY arising from my participation in the Event.
I acknowledge and understand that my participation in the Event is voluntary. I acknowledge and understand the scope, nature, and extent of the risks involved and expressly, voluntarily, and irrevocably assume any and all risks of loss and/or damage to property, illness, injury, and/or death arising from my travel to and attendance and participation in the Event, whether or not contemplated in this Agreement and regardless of how it was caused.
I acknowledge and understand that I am fully responsible for managing myself, my actions and my emotions in connection with the Event and am solely responsible for all actions I take and things I say during the Event.
- Payments and Refunds
All payments are non-refundable. Full payment is required to confirm registration. The event is limited in size and will fill quickly. Registrations are on a first come, first serve basis. I understand that my registration is not confirmed and payment is not deemed made until full payment is received and you receive a confirmation invoice. WAHLS reserves the right to place me on a waiting list should the space be unavailable when payment is submitted. Payment will only be refunded if the space is sold out. Payment is accepted by, Visa, MasterCard, Discover/Novus, American Express and PayPal.
- Cancellations
Cancellation by Attendee. NO REFUNDS WILL BE GIVEN. In the event of cancellation, I will be given access to the pre-recorded Wahls Seminar and materials from the seminar. I am solely responsible for a cancellation of hotel, airline, and/or car rental reservations. WAHLS is not responsible for any consequential or other losses resulting from my cancellation of the Seminar.
Cancellation by WAHLS. In the unlikely event of cancellation by WAHLS, if specific speakers are cancelled, the seminar will be continued with alternative speakers and prerecorded material as needed to conduct the live event. Alternatively, if the entire live seminar is cancelled, I will be provided access to a pre-recorded version of the specific WAHLS Seminar. NO REFUNDS WILL BE GIVEN. WAHLS is not responsible for any consequential or other losses resulting from WAHLS’ cancellation of the Seminar.
WAHLS, reserves the right to cancel or reschedule for any reason, including insufficient demand or force majeure. If the event is canceled, WAHLS’ only responsibility will be to provide access to the pre-recorded seminar lectures, seminar lectures and seminar materials via the seminar membership site. WAHLS cannot assume responsibility for any additional costs or any fees relating to the issuance and/or cancellation of air tickets or other travel arrangements.
- Dispute Resolution
I acknowledge and understand that any dispute, controversy, or claim (collectively, “Claims”) arising out of or related to this Agreement, or the creation, validity, interpretation, breach, or termination of this Agreement will be resolved under Iowa law. All parties agree that all Claims shall be finally and exclusively resolved by binding arbitration, under the Expedited Arbitration rules of the American Arbitration Association. Such arbitration will be held in the Cedar Rapids, Iowa, and may be initiated by any party by sending a written notice request arbitration to the other parties. The parties agree not to contest personal jurisdiction or venue in connection with any such proceeding. Disputes may only be resolved on an individual basis, and I may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.
